Terms and Conditions

 

1. Introduction

Welcome to LEXWAY COURIER SERVICES ( "we," "us," "our"). By engaging our services, you ("the Client") agree to the following Terms and Conditions.

2. Scope of Services

Description: We provide delivery services for legal and non-legal documents, file legal documents in court registries, and deliver small packages. A "small package" refers to any legal item, compliant with British Columbia and Federal Laws, typically weighing under 2 kg (4.4 lbs).

Service Areas: Our services are currently available within the Tri-City area, Maple Ridge, Pitt Meadows, Surrey, Delta, and New Westminster. Delivery timelines vary based on the selected service type. Service areas may change in the future, but any updates will be communicated to clients in advance.

Tracking: Clients can track their shipments through our system. Once the item(s) are delivered, our service is considered fully rendered.

3. Payment Terms

Fees: Our fees are listed on our Prices & Orders page. Prices are subject to change; however, any adjustments will be discussed with clients in advance.

Payment Schedule: Payments are due upon completion of services and receipt of the invoice, which is typically issued within two weeks after service completion. Clients may also choose to make a payment at the time of service. Accepted payment methods include e-transfer, and cheque. At this time, we do not accept credit card payments. 

Late Payment Penalties (After 15 days): A 10% late fee will be added to the outstanding balance.​

Taxes: At this time, GST is not applicable to our services. Should this change in the future, clients will be notified in advance.

4. Confidentiality

We are committed to protecting any sensitive information exchanged during our services. We will not disclose such information without the Client's consent, except as required by law.

5. Limitation of Liability

We are not liable for damages arising from unforeseeable events or force majeure situations that may impact our services.

6. Indemnification

The Client agrees to indemnify and hold us harmless from any claims arising from their use of our services.

7. Amendments

Lexway Courier reserves the right to modify these Terms and Conditions at any time, at its sole discretion, in accordance with applicable laws. Any updates will be communicated through our official channels, and continued use of our services after such changes constitutes acceptance of the revised terms.

8. Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada.

9. Dispute Resolution

Any disputes will be resolved through mediation or arbitration before pursuing legal action.

 

Refund & Cancellation Policy

10. Order Cancellation

• Clients may cancel a scheduled delivery at least 2 hours before the pickup time without any charge.

• Cancellations made less than 2 hours before the pickup time may be subject to a cancellation fee of 50% of the delivery cost to cover scheduling and operational expenses.

11. Refund Policy

• If Lexway Courier cannot complete a delivery due to unforeseen circumstances (e.g., vehicle breakdown, extreme weather, or operational issues), clients will receive a full refund or credit towards a future delivery.

• Refunds will not be issued for incorrect address submissions, recipient unavailability, or delays caused by clients. However, redelivery may be arranged for an additional fee.

• Once a delivery is successfully completed, refunds are not available.

12. Service Adjustments

• If a client requests a service change (e.g., upgrading to Express Delivery) after the order has been placed, additional charges will apply.
